PROTECTION OF PERSONAL DATA
PREAMBLE
Through the PLATFORM accessible at https://www.opendatasoft.com/fr/, OpenDataSoft provides a service in SaaS mode to enable the dissemination of public data of the economic and financial ministries (MEF) via a dedicated portal.
This service provides:
- The publication of datasets for MEF data producers
- Data exploration and visualization for users.
- Consultation and reuse of data
This Personal Data Protection Policy is addressed to you, in your capacity as a user of the portal accessible at https://data.economie.gouv.fr and aims to inform you of the manner in which your personal information may be collected and processed by the economic and financial ministries.
Respecting your privacy and your personal data is a priority for the MEFs, which are committed to comply with the legislation relating to the protection of personal data, and in particular with the amended law n°78-17 of January 6, 1978, known as the "Informatique et Libertés" law.
DEFINITIONS
- BENEFICIARY : refers to the end-user benefiting from a right of access to the DATASETS published by MEFs.
- DATA SETS : designates the data produced by the MEFs, published on the MEFs' open data portal and made accessible to all USERS.
- USERS : refers to all categories of users of the portal. The following are thus considered as USERS :
- BENEFICIARIES accessing the DATA SETS,
- Producers of DATA SETS.
- The administrators of the portal
IDENTITY OF THE DATA CONTROLLER
Legal reminder : The data controller is, according to the Data Protection Act, the person who determines the means and purposes of the processing. The contractor is a person who processes personal data on behalf of the controller and acts under the authority of the controller and on the instructions of the latter.
Your personal data are collected and processed by the MEF, which are responsible for the processing of personal data.

OpenDataSoft is a subcontractor of the MEFs when they collect and process the data via its portal, which the MEFs administer under their sole responsibility.
Considering the above, the present personal data protection policy concerns the data processing carried out by the MEFs in the context of the exploitation of its portal.

PURPOSES OF THE PROCESSING
The purposes of the processing are :
- The publication of datasets for MEF data producers
- Data exploration and visualization for users.
- Consultation and reuse of data
- The elaboration of statistics to improve the portal's operation and the quality of the services it offers.
The legal basis of this processing is the public interest mission entrusted to the MEFs, namely the implementation of the principle of making public data available as set out by the law (LOI n° 2016-1321 of October 7, 2016 for a digital Republic)
PERSONAL DATA
The personal data processed concern: e-mail address, surname, first name, connection data, login, password, cookies.
Personal data may be included in the data sets published on the portal.
MEF may collect personal data :
- When you visit the portal.
- When you use the features offered on the portal.
- During exchanges with the MEFs or with other BENEFICIARIES via the portal.
Concerning cookies, it is specified that the information stored in your terminal (e.g. cookies) or any other element used to identify you for audience statistics purposes are not kept beyond a period of thirteen (13) months. After this period, the raw traffic data associated with an identifier is either deleted or anonymized.

DATA RECIPIENTS
The recipients of personal data are the beneficiaries when the datasets include personal data.
PERIOD OF DATA RETENTION
Personal data is kept for the duration of the account opening, plus 45 days from the date of the deletion request.
Personal data of administrators is kept as long as it is relevant.
YOUR RIGHTS
You are reminded that, in accordance with the provisions of the regulations relating to the protection of personal data and in particular the law n°78-17 known as "Informatique et Libertés" of January 6, 1978, you have the right to access, rectify, update, block or delete personal data concerning you, which are inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication or conservation is prohibited.
You may also object, on legitimate grounds, to the use of your personal data in the present processing.

SECURITY
The MEF respects the French law on data processing and liberties regarding the security and confidentiality of your data.
In this respect, the MEF take the appropriate precautions, with regard to the nature of your data and the risks presented by the processing, to preserve the security of the data and, in particular, to prevent them from being deformed, damaged or accessed by unauthorized third parties (physical protection of the premises, authentication process with personal and secure access via confidential identifiers and passwords, journaling of connections, encryption of certain data, etc.).
